LICENSING TERMS

Windigo Images pricing is based on the size of the image you need, not any specific use. You don’t have to pay additional fees on a use-by-use basis.
You may use a purchased image multiple times for multiple purposes without incurring additional fees.
You are welcome to use watermarked content from our site on a complimentary basis for test or layout use only.
Watermarked images cannot be used in final materials or any publicly available materials.
Standard license includes the following rights:
Non-exclusive rights – other customers can license the same content.
Worldwide rights – Content can be used anywhere geographically.
Perpetual rights – Content can be used for an unlimited period of time by one user.
Unlimited rights – Content can be used in an unlimited number of projects and in any media subject to restrictions below:

TERMS AND CONDITIONS

Ownership of the Site and Its Contents.

This Site is owned by Windigo Images. Unless indicated, all of the content featured or shown on this site, including, but not limited to, photographic images, text, graphics, data and the selection, layout and arrangement is owned by Windigo Images.

Windigo Images protects copyright interest. In the event an infringement is discovered, you will be notified and invoiced the industry standard TRIPLE FEE for unauthorized usage and/or prosecuted for Copyright Infringement in the U.S. Federal Court where you will be subject to a fine of USD $150,000.00 statutory

damages as well as all court costs and attorney’s fees. You represent and warrant that you will comply with all applicable laws and regulations, including, without limitation, those relating to the Internet, data, email, privacy, and the transmission of technical data exported from the United States or the country in which you reside.

All elements of the Site, including the Windigo Images content, are protected by copyright laws relating to the protection of intellectual property.

Use of the Site: You are specifically prohibited from: (a) downloading, copying, or re-transmitting any or all of the Site or Windigo Images content without, or in violation of a written license or agreement with Windigo Images; (bl using any data mining, robots or similar data gathering or extraction methods; (manipulating or otherwise displaying the Site or Windigo Images content by using framing or similar navigational technology; (d) using the Site or Windigo Images Content other than for its intended purpose. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws, the laws of privacy and publicity, and applicable communications regulations and statutes.

RESTRICTIONS ON USE OF IMAGES

You cannot:

Use our product as part of another company’s trademark

Use our content by incorporating our imagery into products for mass distribution or sale, i.e., for example, coffee mugs, t-shirts, posters, plaques, or other mass-produced items. Please reach out to us for specific pricing.

No Unlawful Use: You may not use content in a pornographic, defamatory, or other unlawful manner, to promote violence or hatred, or in violation of any applicable regulations or industry codes.

Make our content available so that it can be used by multiple users or use our content in a manner where it will infringe upon any third party’s intellectual property rights.

Use our product in a manner to imply that any person in a photograph uses or endorses a particular product or service or a political candidate, or that a person depicted is suffering from a sickness, ailment, or mental infirmity, without a clear notice on the work that the person depicted is actually a model.

Unless expressly authorized by Windigo Images, content keywords or metadata associated with the content cannot be used for any machine learning or artificial intelligence purposes, or for any technologies designed for or intended for the identification of natural persons. Windigo Images does not represent or warrant that consent has been obtained for such uses with respect to model-released content.

All images are licensed on a non-exclusive basis and prices of all images are the same unless your need is for exclusivity or mass distribution usage.
